PROCARD INTERNATIONAL, LLC
Procard International's rules and policies apply to all Associates, of our current and future subsidiaries including LocalDiscounts.com, PizzaDelivery.com, U.S.Junkmail.com, Inc.. All are known as "Procard International" and you will need to follow all of Procard International's rules and policies. An Associate is any individual who represents and/or markets Procard International's services.
Free Leads
Free leads can only be provided for our Active Associates, due to the high costs. Registered Associates can become Active Associates by activating and maintaining a minimum of one membership.
Independent Contractor Statement
All Associates must review and accept our Independent Contractor Statement prior to being active in the Procard International system. All rules and policies on Procard International's Independent Contractor Statement are fully applicable.
Laws & Regulations
Procard International does not assume any liability for the methods of marketing that are employed by its Associates. It is the individual responsibility of each Associate to follow all FCC, FTC, Internet, State, Federal, and International laws including anti-fax laws and the National Do Not Call Registry. Any time a consumer makes a request not to be called, emailed, or contacted it is the responsibility of the Associate to notify Procard International through the proper form submission provided on Procard International's website and the Associate can not contact that Consumer again. Procard International will not pay any fines, legal fees, nor any other expenses, which an Associate may incur by not following any of the above laws. In order to protect oneself, an Associate can simply review the FTC and FCC online sites to determine what is allowable and not allowable.
Anti-fax Laws
The Federal Telephone Consumer Protection Act of 1991, "FTCPA," (47 U.S.C. § 227) prohibits the sending of unsolicited advertising faxes, and imposes fines and civil liability on companies that break the law. In fact, for each unsolicited advertising fax that you send, you can be sued for $500 if you sent the fax "innocently," or $1,500 if you sent the fax in knowing and willing violation of the law. This would be an individual Associate liability and not the liability of Procard International because we do NOT support such practices.
The National Do Not Call Registry
Contains important rules, which are applicable to any Associate generating his/her own leads and/or receiving company leads. Associates representing Procard International are NOT allowed to make any residential telemarketing cold calls. All cold calls must be business to business, only. If an Associate receives company leads, he/she may call back these leads for a maximum of 2 months. The policy is 3 months, but we want to ensure no chance of error. Because our company leads are the direct result of a consumer specifically requesting details on our services, they can be called back and do not fall under "telephone solicitation."
The following statement from the FTC is applicable for Associates receiving company leads: "If a consumer makes an inquiry or submits an application to a company, the company can call for three months. Once again, if the consumer makes a specific request to that company not to call, the company may not call, even if it has an established business relationship with the consumer. A consumer whose number is not on the national registry can still prohibit individual telemarketers from calling by asking to be put on the company’s own do not call list." E-Mailing Regulations
All leads, whether or not they have phone numbers, can still be emailed after 2 months because the Do Not Call Registry laws do NOT apply to the email laws. Unless an individual requests not to be contacted again from us, you can email that person. If an individual asks not to be contacted in any particular format, we require that you NEVER contact them again and notify our company through our Removal System (see below)
Removals
Each time an Associate contacts a consumer or job applicant who requests not to be contacted again, the Associate is required to update his/her records and to notify Procard International. The steps for notification are as follows:
Associate Leads Removal: Please complete our Removal Form.
Consumer Leads Removal: Please Email Leads@ProcardInternational.com with the full name, phone number, and date.
Membership Cancellations, Refunds and Chargebacks.
Members can use the services as much and as often as they like and discontinue at any time by mailing in their cancellation. If for any reason, a customer is not completely satisfied with our products or services, the customer may cancel and get a full 100% guaranteed credit refund, excluding registration fee, if the cancellation is postmarked within 30 days of activation. After 30 days, there is no refund since their monthly charge would just stop being charged to them. Associate commissions will be determined, accordingly. Procard International pays its Associates only after applications are fully completed and monies collected. For members who do cancel, all parties who received monies from that sale will be charged back, in full, if a refund is provided.
Sponsor Credit
The access code submitted by the consumer or job applicant will be the ONLY access code to receive the credit for the activation. In the event an access code is not submitted, Procard International has the full right to receive the credit. Valid access codes submitted are NOT reversible nor re-assignable to another Associate.
